Your Questions Answered

Expert Guidance on Family Law Matters

We understand that legal concerns can be overwhelming. That’s why we’ve compiled answers to the most common questions to help you gain clarity and confidence about your family law case.

How much does it cost to file for divorce?

The court filing fee in California is typically $435. However, if you qualify for a fee waiver based on income, you may not have to pay. Working with a legal document preparer instead of an attorney can also save you thousands in legal fees.

What if my spouse doesn’t respond to the divorce papers?

If your spouse does not file a response within 30 days of being served, you can request a default judgment, allowing the divorce to proceed without their participation—as long as you've met all court requirements.

How is child custody decided in California?

Custody is based on the best interests of the child, considering factors like each parent’s ability to care for the child, the child's relationship with each parent, and stability. Parents can agree on a plan, or the court will decide.

Can child support be changed after a court order??

Yes. If there’s a change in circumstances—such as income, job status, or custody arrangement—either parent can request a modification of the support order through the court.

What’s the difference between a will and a living trust?

A will takes effect after death and often requires probate. A living trust takes effect immediately and allows assets to be transferred to beneficiaries without going through probate, saving time and legal costs.

Do I need a will if I already have a trust?

Yes. A “pour-over will” is recommended even with a trust. It ensures that any assets not included in the trust are transferred into it upon your death and that your final wishes are fully documented.
