Our Trust & Will Services

Revocable Living Trusts

A Revocable Living Trust is a legal document that allows you to manage and protect your assets during your lifetime and smoothly transfer them to your beneficiaries after death—without going through probate. It can be changed or revoked at any time, offering flexibility, privacy, and control over your estate.

Irrevocable Trusts

An Irrevocable Trust is a permanent legal arrangement that transfers ownership of assets out of your estate, typically for tax, asset protection, or Medicaid planning purposes. Once established, it cannot be altered or revoked without beneficiary consent, providing strong protection against creditors and reducing estate taxes for long-term planning.

Last Will & Testament

A will, also known as a testament, is a legal document that allows a person to designate one or more individuals to manage their estate and outline how their property should be distributed after death. Anyone of legal age and sound mind can create a will without a lawyer. However, specific legal requirements must be met for the will to be recognized by the probate court. Since you won’t be able to correct errors after death, it’s essential to have your will reviewed by a professional to ensure its validity.

Your Questions Answered

Expert Guidance on Trust & Wills

We understand that legal concerns can be overwhelming. That’s why we’ve compiled answers to the most common questions to help you gain clarity and confidence about your options.

What’s the difference between a will and a trust?

A will goes into effect after your death and must go through probate, while a trust can take effect during your lifetime and avoids probate, allowing for faster, private distribution of assets.

Do I need both a will and a trust?

In many cases, yes. A trust manages and distributes major assets, while a will can cover personal wishes, guardianship of minors, and assets not included in the trust.

What happens if I die without a will or trust?

Your assets will be distributed according to state intestacy laws, which may not reflect your wishes. The court will also decide guardianship for any minor children.

Can I change or revoke a trust or will?

Yes, revocable trusts and wills can be changed as long as you’re of sound mind. Irrevocable trusts, however, typically cannot be altered without court approval or beneficiary consent.

Does a trust avoid taxes?

A trust may help with estate tax planning, but it doesn’t eliminate taxes. Some trusts can reduce estate size or create tax advantages depending on how they’re structured.

Do trusts protect my assets from creditors?

Irrevocable trusts may offer protection because the assets are no longer legally yours. Revocable trusts, however, do not protect against creditors during your lifetime.

What is probate, and why do people try to avoid it?

Probate is the court-supervised process of validating a will and distributing assets. It can be time-consuming, public, and costly—so many use trusts to avoid it.
